COBANE GENERAL TERMS AND CONDITIONS
for a pleasant study and living environment

Article 1 Key Handover

The key or badge will only be handed over after the full deposit has been transferred to Cobane’s account. The tenant receives a copy that grants access to the main entrance, student accommodation, and common areas. In case of loss or damage, a Cobane employee must be immediately notified. The cost of obtaining a new copy is the responsibility of the tenant.

Article 2 Fire Safety

2.1 To ensure the safety of all tenants, smoking is prohibited in all buildings and student accommodations rented and/or managed by Cobane.

2.2 To be well-informed, the tenant commits to fully participate and attend periodic fire drills organized by Cobane.

2.3 It is prohibited to place objects in common corridors or stairwells.

2.4 Fryers, fondue sets, candles, incense… are not allowed in the student accommodation or common areas.

2.5 It is strictly forbidden to cover smoke detectors.

2.6 If the tenant or their visitor(s) are responsible for unjustified triggering of the fire alarm, an intervention fee of €250.00 will be systematically charged, with the possibility for the landlord to prove additional actual damages.

2.7 Fire prevention, detection, and fighting devices, means, and equipment may only be used in case of emergency. Misuse will be penalized by a fine of a fixed amount of €250.00, with the possibility for the landlord to prove additional actual damages.

Article 3 Peace and Quiet

The tenant must behave respectfully towards other tenants and neighbourhood residents, both in common areas and in their private space. Everyone’s nighttime rest must be respected between 10:00 PM and 7:00 AM. Parties or large gatherings in the building are not allowed, except with prior written agreement from Cobane.

Article 4 Order, Cleanliness, and Maintenance

4.1 The tenant commits to occupying and maintaining the student accommodation as a responsible head of household.

4.2 Three times per academic year, an announced visit is organized to check for any technical defects, potential damage due to a lack of proper maintenance, and to avoid costs at the end of the rental period. The landlord commits to ensuring peaceful enjoyment and only entering the student accommodation for the purpose of the quarterly inspection, hygiene, safety, technical maintenance/repairs, or force majeure.

4.3 The landlord is responsible for maintaining corridors and stairwells. Tenants are responsible for cleaning shared kitchens. Tenants must ensure kitchens are clean before weekends and empty trash bins.

4.4 Modifying or replacing window coverings and painting interior doors, exterior doors, facade, frames, or other elements inside and outside the rental in a different color than the current one is prohibited.

4.5 Accessing roofs and disposing of waste on them is forbidden.

Article 5 Visitors

Visitors are allowed in the building, but no more than 5 visitors at the same time. Occasional lodging of a visitor is allowed, but frequent overnight stays by non-tenants are not permitted.

Article 6 Waste

6.1 Household waste must be sorted by the tenant according to local rules. Waste should not be left in common areas or in front of containers.

6.2 When moving out, the tenant is requested not to dispose of large cardboard boxes and plastic film in the trash bins, but to take them home or deposit them at a container park of their choice.

Article 7 Blockages

It is forbidden to throw waste or hair into sinks, showers, or toilets. The cost of structural unblocking is the tenant’s responsibility. It is the tenant’s responsibility to regularly clear the drain of any blockages..

Article 8 Animals

It is forbidden to keep pets in student housing. The only exceptions allowed are dogs for people with physical, visual, auditory, or cognitive limitations. These individuals are asked to provide a medical certificate to the landlord.

Article 9 Bicycles

Bicycles must always be placed in the designated bicycle racks. Improperly parked bicycles will be removed periodically.

Article 10 Damages and Defects

11.1 The tenant agrees to immediately report any act of vandalism or other forms of damage, both to the student housing and common areas, to a Cobane employee. The tenant is responsible for damages caused by themselves or their negligence, as well as any other person they have granted access to the student housing.

11.2 All tenants are jointly and severally responsible for any abnormal damage caused to the common areas if the perpetrator cannot be identified.

11.3 Defective light bulbs must be replaced with high-quality, energy-efficient LED bulbs. The replacement of light bulbs is always the tenant’s responsibility, with the exception of common areas.

11.4 It is only permitted to hang wall decorations in designated areas. It is forbidden to paint or wallpaper a room without prior written permission from Cobane. Furthermore, it is forbidden to drill holes in tiles, walls, and/or floors.

It is forbidden to affix posters, signs, stickers, or other objects inside, on, or around your room and/or the building. Posters, stickers, or other objects will be immediately removed without notice.

Article 12 Additional Appliances

If the tenant wishes to install additional electrical appliances such as refrigerators, freezers, air conditioners, ovens, etc., in their room or common areas, they must inform the landlord.

If no notification is made to the landlord and an additional appliance is discovered, an administrative fee of €150 will be charged.

Article 13 On-call Services

In case of problems or questions, you can always contact the landlord, who will send someone on-site if necessary. If the intervention turns out to be unnecessary or avoidable afterwards, a fixed amount of €75.00 will be charged to the caller/responsible party.

Unnecessary or avoidable interventions include :
– technical interventions that prove unnecessary
– interventions in case of breach of contract provisions
– interventions for mediation in case of nuisance..

Article 14 Early Termination of Contract Not Possible

Artikel 15 Contract Renewal

15.1 The rental contract has a duration of 12 rent months and is not automatically renewed. If the tenant wishes to keep their room in the student residence for the following academic year, the new contract must be signed no later than June 15th. The rent will be adjusted according to the market and/or in proportion to the positive health index. If no new rental contract is signed before June 15th, the room will be offered to new prospective tenants.

15.2 If the tenant does not wish to renew the rental contract, they must inform the landlord no later than May 15th.

15.3 In the absence of information on a possible renewal, the room is immediately rented to new prospective tenants.

Article 16 End of Contract

The landlord wishes to guarantee a clean and quality room for the next tenant. Therefore, the student housing must be completely emptied and cleaned before 10:00 am on the last day of the contract. Afterward, a guided tour takes place, at the end of which the incoming inventory is compared to the condition.

If cleaning and/or repair work is not carried out in a timely manner or properly, the indicated and associated prices will be deducted from the security deposit :

– Comprehensive cleaning of the kitchen area: 150 EUR/kitchen area
– Window/mirror cleaning: 20 EUR/square meter
– Kitchen appliance cleaning: 40 EUR/unit
– Floor cleaning: 10 EUR/square meter
– Comprehensive bathroom cleaning: 150 EUR
– Descaling faucet/toilet: 50 EUR/faucet or toilet
– Replacing curtain rods: 70 EUR/linear meter and minimum 1m
– Painting/touch-ups: 25 EUR/square meter
– Removal of waste/materials left behind: 20 EUR/bag
– Free room/studio: 200 EUR/square meter
– Repair of general damages: as per specification

Article 18 Notice of Default

If the tenant repeatedly violates the provisions of the rental agreement and the terms, the landlord may decide to terminate the contract with immediate effect and associate a compensation for damages and interest.

Cobane follows the procedure below :
– 1st offense: the tenant receives a first formal warning by email ;
– 2nd offense: the tenant receives a second and final warning by email ;
– 3rd offense: immediate termination of the contract by registered letter to the tenant’s primary residence address.

These General Terms and Conditions are in force from the signing of the rental agreement and apply to all Cobane tenants.
